Terms & Conditions

Please note: This is a non-binding translation. The German version is legally binding.

§ 1 Scope of Application

These Terms & Conditions apply to all orders placed via the online shop walleria.de between Julian Sekora (hereinafter "we") and consumers within the meaning of § 13 BGB.

§ 2 Conclusion of Contract

The presentation of products in the shop is not a binding offer, but an invitation to place an order. At the checkout, you enter your details and select a payment method. Clicking "Review order" takes you to an overview where you can check all details and correct them using the back function. By clicking the "Buy now" button, you submit a binding offer. The contract is concluded when we confirm your order by email, dispatch the goods, or make the download available. The contract language is German; the contract text is stored by us and sent to you by email.

§ 3 Personalised Products

For personalised posters (name, date, custom text, your own ultrasound image), the live preview in the shop serves as the print template. Please check the spelling and details before ordering. We use your details exactly as entered – including spellings that look unusual, as they may be intentional. There is no entitlement to subsequent changes.

§ 3a Your Own Photos and Texts

(1) If you upload your own photos or enter your own texts for a poster, you assure us that you are entitled to do so: you are the author or hold the necessary rights of use, and any persons shown agree to the use.

(2) The content must not infringe third-party rights (in particular copyright, trademark, name and personality rights) or any laws. We do not process unlawful, violence-glorifying, pornographic or discriminatory content; in that case we may decline the order and will refund any payments already made.

(3) You grant us the simple right, limited to fulfilling your order, to store, edit (e.g. cropping, conversion into the poster style) and reproduce the content. Any other use, such as advertising, only takes place with your separate consent.

(4) If third parties assert claims against us because of content you provided, you shall indemnify us against these claims and reimburse the reasonable costs of legal defence, insofar as you are responsible for the infringement.

§ 4 Digital Products

Digital posters are provided as a download link via email once payment is received (JPG in the specified formats). You receive a simple, non-transferable right of use for private purposes; resale, distribution, and commercial use are not permitted. Before ordering digital files, you expressly agree in the cart that we may begin providing the service before the expiry of the cancellation period, and you acknowledge that you will lose your right of cancellation as a result (§ 356 para. 5 BGB). We will confirm this consent in the email containing your download links.

§ 5 Prices and Payment

All prices are in Euros including statutory VAT and including shipping within Germany. Payment is made via Shopify Payments (specifically credit and debit card, Apple Pay, Google Pay, and – where available – Klarna) or via PayPal. You can see which payment methods are available to you at the checkout. The amount is due upon completion of the order.

§ 6 Delivery and Shipping

We only deliver printed posters within Germany. We offer digital files to customers in all member states of the European Union; they are delivered by email, and no physical shipping takes place. Personalised posters are printed within 1–2 business days; shipping takes 2–3 business days. Shipping within Germany is free (included in the price), with no minimum order value. Small sizes are shipped flat and bend-proof, sizes from 30×40 cm are rolled in a shipping tube. Delivered without a frame unless a frame was ordered.

§ 7 Retention of Title

The goods remain our property until full payment has been made.

§ 8 Right of Cancellation

Consumers are entitled to a right of cancellation in accordance with the cancellation policy. The right of cancellation is excluded for goods made to customer specifications or clearly tailored to personal needs (§ 312g para. 2 no. 1 BGB), as well as for digital content once performance has begun with your consent (§ 356 para. 5 BGB). You can also declare your cancellation online using our cancellation function: walleria.de/pages/vertrag-widerrufen.

§ 9 Warranty

Statutory warranty rights apply; for digital content, §§ 327 et seq. BGB apply. If a poster arrives damaged or faulty, sending a photo to hallo@walleria.de helps us – we will then reprint it for free or redeliver the file. Colour variations between the screen display and the print are technically unavoidable and do not constitute a defect, provided they are within standard commercial tolerances.

§ 10 Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, limb, or health. In cases of slight negligence, we are only liable for the breach of essential contractual obligations, limited to the foreseeable damage typical for this type of contract.

§ 11 Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country in which you have your habitual residence remain unaffected.
